Terms of Service

1. Acceptance of Terms

By creating an account or using Deliproof ("the Service"), you agree to these Terms of Service. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these terms.

2. Description of Service

Deliproof is a delivery dispute automation platform that helps restaurants capture photo evidence of orders, match evidence to chargeback claims from delivery platforms, and recover lost revenue. The Service includes:

  • Photo and video evidence capture linked to delivery orders
  • Automatic matching of evidence to platform disputes and adjustments
  • Dispute filing on your behalf with delivery platforms
  • Multi-location order management and payout tracking
  • Team access with role-based permissions

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and must notify us immediately of any unauthorized access.

4. Acceptable Use

You agree not to:

  • Upload fabricated, manipulated, or misleading evidence
  • File fraudulent disputes or misrepresent order contents
  • Use the Service for any illegal activity
  • Interfere with or disrupt the Service infrastructure
  • Attempt to access other users' data
  • Resell or redistribute the Service without written permission
  • Use the Service in a way that violates delivery platform terms of service

5. Evidence & Disputes

Deliproof stores and submits photo/video evidence on your behalf to challenge delivery platform chargebacks. You are responsible for:

  • Ensuring evidence accurately reflects the order at the time of driver pickup
  • Reviewing disputes before submission (when manual approval is enabled)
  • Providing truthful information in all dispute claims

Deliproof is not liable for dispute outcomes. Platform decisions on chargebacks are final and determined by the respective delivery platform.

6. Third-Party Integrations

The Service integrates with third-party delivery platforms (Pyszne.pl, Glovo, Wolt, Bolt Food, Uber Eats) and infrastructure providers. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for changes, outages, or policy modifications by third-party services.

7. Payment and Billing

Paid plans are billed in advance on a monthly or annual basis via Stripe. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Free trial periods, if offered, may be limited in features or duration.

8. Data Ownership

You retain ownership of all data you provide to the Service, including business information, order data, and photo/video evidence. You grant Deliproof a limited license to use this data solely to provide the Service (including submitting evidence to delivery platforms for disputes). 9. Service Availability

We aim to provide high uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance with reasonable notice. We are not liable for downtime caused by factors beyond our control.

10. Termination

You may cancel your account at any time. We may suspend or terminate your account if you violate these terms, submit fraudulent evidence, fail to pay fees, or if required by law. Upon termination, your data will be deleted within 30 days, except as required for legal compliance.

11. Limitation of Liability

To the maximum extent permitted by law, Deliproof shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, failed disputes, unrecovered chargebacks, or business opportunities, arising from your use of the Service.

12. Indemnification

You agree to indemnify Deliproof against any claims, damages, or expenses arising from your use of the Service, submission of fraudulent evidence, your violation of these terms, or your violation of any third-party rights.

13. Changes to Terms

We may modify these terms at any time. Material changes will be communicated via email or in-app notice at least 30 days before they take effect. Continued use after changes constitutes acceptance.

14. Governing Law

These terms are governed by the laws of the Republic of Poland. Any disputes shall be resolved in the courts of Warsaw, Poland.
